A registered trademark gives you the exclusive right to use your mark for the goods or services it covers, and the standing to sue for infringement rather than relying on the weaker common-law remedy of passing off.

Correct classification under the NICE Classification and e-filing with the Registry, giving you the application number and priority date the same day.

Where the Registry raises objections (Section 9 or 11), we file a response with supporting evidence of distinctiveness or prior use.

Publication & opposition

The mark is published in the Trade Marks Journal for a four-month opposition window; we defend the application if it is opposed.

Registration certificate

Once unopposed or the opposition is decided in your favour, the Registrar issues the registration certificate, valid for 10 years and renewable indefinitely.

Trademark Registration — common questions

The government fee is ₹4,500 per class for individuals, sole proprietors, startups and small enterprises e-filing, and ₹9,000 per class for other entities; professional fees are quoted separately and depend on the number of classes and complexity of the search.

If unopposed, roughly 8–12 months from filing to registration; opposed marks can take considerably longer depending on the proceedings.

You have two months to file a counter-statement after the opposition notice; we represent applicants through the evidence and hearing stages before the Registrar.

Yes — ™ can be used once you've filed the application; the ® symbol is reserved for marks that have actually been registered.
